Aviation Minister Orders Suspension Of Arik Air Operations; Amcon Responds

The Minister of Aviation and Aerospace Development, Festus Keyamo, has issued a directive for the grounding of Arik Air’s operations. However, no official statement has been released by the Minister or the Ministry of Aviation to explain the reason behind this decision. Nevertheless, sources suggest that the grounding may be related to ongoing legal issues.

Recently, an Abuja Court ordered the sale of Arik Air’s aircraft to settle debts owed to Arthur Eze and other creditors. The court ruling specifically mentioned the sale of aircraft bearing registration numbers B737-700/5N-MJF, B737-0/5N-MJQ, and Dash 8-Q400, 5N-BKK.

In response to the Minister’s order, Asset Management Corporation of Nigeria (AMCON), which currently manages the airline under receivership, expressed their disappointment. CEO Captain Roy Ilegbodu issued a statement stressing that the grounding of Arik Air’s fleet has severe consequences for passengers, employees, and the Nigerian economy as a whole. AMCON highlighted the disruption of vital domestic routes, leaving passengers stranded and increasing travel costs. The decision was described as harmful to everyday Nigerians who rely on Arik Air’s flights for their business and personal needs.

The airline also emphasized that the Minister’s order disregards ongoing judicial processes and an existing case in the Federal High Court, where AMCON asserts its secured interest in Arik’s assets. They pointed out that a writ of attachment was issued on July 18, 2024, targeting the aircraft. However, on July 25, 2024, the High Court of the FCT instructed all parties to maintain the status quo as per an originating motion filed by AMCON. With these legal proceedings in place, Arik Air expressed confusion as to the grounding of their fleet, viewing it as an overreach of the ongoing judicial processes and court directives.

Arik Air emphasized the importance of upholding the rule of law and the rights of secured creditors. They noted their commitment to following the legal process and having faith in the judiciary to resolve these matters fairly. The airline appealed for the authorities to reconsider the grounding order, highlighting the impact on public services and the economy. They reassured their passengers and employees that they are working tirelessly to resolve the situation and expressed gratitude for the support and understanding received.

The statement also conveyed regrets for any inconvenience caused to valued passengers.

According to THISDAY, the borrowed money under the previous management of Arik Air’s founder was not serviced by AMCON, as the agency claims it only pays creditors.
